Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.

By way of derogation from the above, in the case of a contract for the delivery of goods in several partial deliveries or pieces, the cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial delivery or the last piece.

By way of derogation from the above, in the case of a contract for the regular delivery of goods over a specified period of time, the cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the first goods.

To exercise your right of withdrawal, you must inform us (Panacaia UG, Am Stener Berg 41k, 13125 Berlin, email address: beratung@panacaia.bio, telephone number: +49 30 837 91760) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

We will cover the cost of returning the goods if you use the return label provided by us. Otherwise, you will be responsible for the direct cost of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Exclusion or premature expiry of the right of withdrawal

• The right of withdrawal expires prematurely if we have only begun to execute the contract after you have given your express consent and simultaneously confirmed your knowledge that you will lose your right of withdrawal upon commencement of our contract fulfillment, and if we have made the content of your declaration available to you on a durable medium within a reasonable period after conclusion of the contract, but no later than upon delivery of the goods. We point out that we may make the conclusion of the contract dependent on the aforementioned consent and confirmation.

Linked/Financed Contracts

If you finance this agreement with a loan and later revoke it, you are no longer bound by the loan agreement, provided both agreements form a single economic unit. This is particularly likely if we are also your lender or if your lender uses our assistance with financing. If the loan has already been paid to us when the revocation takes effect, your lender will assume our rights and obligations arising from the financed agreement with regard to the legal consequences of the revocation or return. The latter does not apply if this agreement concerns the acquisition of financial instruments (e.g., securities, foreign currencies, or derivatives).

If you want to avoid a contractual obligation as much as possible, exercise your right of withdrawal and also revoke the loan agreement if you are also entitled to a right of withdrawal for this.

Instructions for returning goods

• The following modalities mentioned in this section are not a prerequisite for the effective exercise of the right of withdrawal.

• Please do not send the goods to us freight collect.

• Please return the goods as a prepaid parcel to the specified return address and keep the delivery receipt.

• Please avoid damaging or contaminating the goods.

• If possible, please return the goods to us in their original packaging and outer packaging, including all accessories and packaging components. If you no longer have the original packaging or outer packaging, please use other suitable packaging to ensure adequate protection against transport damage and to avoid any claims for damages resulting from inadequate packaging.
